0.5px;">今年3月，据媒体报道，国内某地一家超市上班的员工王某无视社区的敦促，连续多次无故拒不执行当地防控新冠病毒疫情应急指挥部关于开展新冠病毒核酸检测的相关通告，未进行核酸检测。根据《中华人民共和国治安管理处罚法》第五十条第一款第一项规定，王某已构成拒不执行紧急状态下依法发布的决定、命令的违法行为，当地警方依法对其处以行政拘留五日的处罚。</span></p><p 0.5px;">余钢介绍，国家卫健委在2020年第1号文件中，明确将新冠肺炎纳入《中华人民共和国传染病防治法》规定的乙类传染病，并采取甲类传染病的预防、控制措施。在疫情发生时，所有的单位与个人则必须履行《中华人民共和国传染病防治法》第十二条规定的法定义务，即“必须接受疾病预防控制机构、医疗机构有关传染病的调查、检验、采集样本、隔离治疗等预防、控制措施，如实提供有关情况。”违反上述法定义务的，依照国务院发布的《突发公共卫生事件应急条例》之规定，对有关责任人员依法给予行政处分或者纪律处分；触犯《中华人民共和国治安管理处罚法》，构成违反治安管理行为的，由公安机关依法予以处罚；构成犯罪的，依法追究刑事责任。</span></p><p 0.5px;">“特别要注意的是，如果违反传染病防治法的规定，拒绝执行县级以上人民政府、疾病预防控制机构依照传染病防治法提出的预防、控制措施的，引起甲类传染病以及依法确定采取甲类传染病预防、控制措施的传染病传播或者有传播严重危险的，将被处三年以下有期徒刑或者拘役;后果特别严重的，处三年以上七年以下有期徒刑。”余钢说。</span></p><p style="line-height:
