<section data-role="outer" label="edit by 135editor"><section data-role="paragraph"><span style="font-size: 17px;">2021年4月间，陈某智从上家陈某林（另案处理）处购买大量毒品饮料，花言巧语将其包装成一种新型饮品，并称该饮品有大力提神奇效，喝完后人飘飘欲仙，并保证绝不上瘾，且一般无法被查验出，以此向他人推销售卖。</span><span style="font-size: 17px;">应陈某林要求，陈某智以其本人身份申领电话卡，利用该电话号码开设支付宝账户和微信账户，并将上述电话卡及账户交予陈某林使用。两个月内，陈某林利用上述支付宝账户收取下家支付的毒资1.36万元，并转至陈某智的银行卡，由陈某智持卡到银行取现。</span>

<p><span style="font-size: 17px;">某次交易中，因买方无法当场面交，陈某智遂将其购买的饮品交给美团跑腿骑手送至指定地点，被公安人员当场抓获。<span style="color: rgb(171, 25, 66);"><strong>经检测，该饮品实为含γ-羟基丁酸的毒品饮料。随后，公安人员在陈某智租住的地方查获该毒品饮料实物615支共147.35千克，以及含咖啡因的毒品实物93包共2.86千克。</strong></span></span></p>
<p><span style="font-size: 17px;">公诉机关指控陈某智犯贩卖毒品罪、洗钱罪，向法院提起公诉。</span></p>

<p><span style="font-size: 17px;"><span style="letter-spacing: 0.578px;">在本案中，陈某智将本人的电话卡及微信、支付宝账户提供给其他毒贩使用，并帮助将毒资提现，属于毒品犯罪的洗钱行为。从司法实务来看，一些人员出于“逐利动机”，被毒品犯罪分子许诺的蝇头小利所吸引，或被毒品犯罪分子所蒙骗，而出借自己的电话卡、微信账户或银行卡，</span><span style="letter-spacing: 0.034em;">为毒贩提供接收、转移毒资的帮助，使得毒品交易隐蔽进行。</span></span></p>
