0em;">2021年5月，王一的朋友邀请他在境外某赌博网站上玩“百家乐”，游戏规则很简单，连上境外赌博网站后，由荷官发扑克牌，两张牌翻开后比大小。抱着试试看的心理，王一很快赢到三万多元，提现也非常顺畅，这让他对该网站深信不疑。但后续若想继续参与网络赌博，就必须有熟人指引，也叫“开线”，需要在境外某赌博网站上开通接口并输入密码及验证码才能进行赌博。</p><p style="text-align:justify;line-height: 1.75em;text-indent: 0em;">尝到甜头的王一向朋友要来了网络赌博组织者刘林的电话，在2021年6至8月、2022年2至5月期间，找到刘林为其“开线”上百次。</p><p style="text-align:justify;line-height: 1.75em;text-indent: 0em;">“像王一这样的大老板很难找，我把他服务好了，就能得到不少好处费。”刘林是社会闲散人员，以赌博为生。在接到王一的电话后，刘林“专职”为王一搞起了服务，每次王一想赌博时，只需一个电话，刘林便会开好房间，联系好赌场，准备好香烟和饮料等，给王一做好后勤保障服务，王一则只管赌博。</p><p style="text-align:justify;line-height: 1.75em;text-indent: 0em;">久赌无赢家，这句话王一也未能幸免。玩的次数多了，王一开始输多赢少，为了翻本，他赌注越下越大，但也越输越多。短短一年时间不到，输掉830余万元身家后，王一选择了报警。</p><p style="text-align:justify;line-height: 1.75em;text-indent: 0em;">2018年以来，以十堰籍公民郑林（批捕在逃）为首的犯罪团伙，在国外组织工作人员通过境外赌博网站实时传输境外实体赌场赌博视频，并建立赌博群，招揽国内赌客利用手机、电脑等工具，进行“百家乐”网络赌博。</p><p style="text-align:justify;line-height: 1.75em;text-indent: 0em;">为打造自己的赌博团队，获取巨额的非法利益，郑林从国内拉拢杨升、张航等人前往缅甸从事赌场管理相关工作。同时，拉拢黄仲、刘刚、陈文等人在国内成立“跑分”团伙，为网络赌博违法犯罪提供支付结算渠道，帮助赌博网站洗钱。</p><p style="text-align:justify;line-height: 1.75em;text-indent: 0em;">“郑林是我的发小，<strong><span style="color: rgb(0, 122, 170);">一开始我在他的赌场玩了几次，结果越输越多，他就让我帮他跑分还债。</span></strong>”黄仲原本经营着自己的小生意，生活也还算富足，直到他输掉自己全部身家还欠郑林200万时，他接受了郑林要求其帮助“跑分”的要求，开始大量购买、租借“两卡”，并雇佣熊涛、魏崎等人组成跑分团伙，从境外聊天软件上接收对应赌博群财务人员指示，通过银行转账的方式为郑林的赌博群提供资金结算服务。</p><p style="text-align:justify;line-height: 1.75em;text-indent: 0em;">经审计，2022年3月至8月期间，黄仲组织团伙成员共使用97个银行账户用于犯罪活动，<strong><span style="color: rgb(0, 122, 0em;">“犯罪团伙利用境外聊天软件进行沟通，使用虚拟货币进行交易，并且大量使用团伙内部默认的特殊用语，逃避侦查、隐藏犯罪的意图十分明显。”茅箭区检察院第二检察部检察官郑冰鑫说。</p><p style="text-align:justify;line-height: 1.75em;text-indent: 0em;">犯罪事实清晰明了，但部分犯罪嫌疑人拒不认罪，如何准确认定犯罪性质，确保罚当其罪？</p><p style="text-align:justify;line-height: 1.75em;text-indent: 0em;">办案检察官斗智斗勇，最终，<strong><span style="color: rgb(0, 122, 0em;">为促进源头治理，茅箭区检察院一方面监督公安机关，对涉赌博犯罪提供技术支持的犯罪事实进行立案侦查。另一方面，向该银行制发检察建议，要求该单位进一步规范制度管理，加强内部监督，强化警示教育，加强办卡实质性审查，对不规范办理银行卡情况进行调查摸排，及时扫除类似隐患，全面加强银行从业人员法律意识和责任意识，严把柜面风险防范“第一道防线”。</p><p
