style=";font-family:仿宋;font-size:20px">申请人应当在劳动争议发生之日起一年内向劳动人事争议仲裁委员会申请仲裁。</span></p><p (1)按要求提交仲裁申请书(按被申请人、第三人人数多少提交);三人以上集体劳动人事争议案件 (法律工作者不得代理)的代理人必须出示本人的律师执业证及授权委托书、集体争议案件代表推荐书及被推荐人身份证明和报当地司法部门备案的重大案件审批表、争议当事人承诺书。(2)身份证复印件; (3)企业注册信息; (4)委托他人代理参加仲裁的,须提交授权委托书; (5)相关证据如劳动合同、暂住证、工作证、厂牌、工卡、工资表(单)、入职登记表、押金收据、以及被处罚凭证和被开除、除名、辞退、解除(或终止)劳动关系通知或证明书等。申请人提交本项证明材料时,应尽量提供,申请人与被申请人存在劳动关系的证明材料若一份都不能提供,则立案无法受理,提交时附原件及复印件,审核后退回原件; (6)工伤案件的申请人,应提供由劳动行政部门作出的工伤认定书或职业病鉴定机构出具的职业病鉴定表和相关医疗机构作出的伤残等级鉴定表或职业病伤残等级鉴定表; (7) 提交材料证据清单; (8)应当提交的其他相关材料。</span></p><p style="font-family:仿宋">①农民工提供资料:民工本人填写的投诉登记表,签字按手印;提供被投诉人姓名、电话;提供劳动合同、工资欠条、民工本人做工工天记录;本人身份证复印件、联系电话等。②包工头提供的资料:施工合同;原始考勤表(由本班组农民工本人签字按手印证明属实);拖欠工资花名册(明确欠薪人数和确切的欠薪数额)、联系电话;工资支付情况、已支付工人工资的凭证。③建筑施工企业提供的资料:公司营业执照、法人资格证明、法人委托书、法人身份证及被委托人身份证复印件、支付农民工工资付款凭证、施工合同、中标通知书、联系电话等。</span></span></p><p style="text-indent: 40px;line-height: 39px"><strong><span style=";font-family:仿宋;font-size:20px">四、</span></strong><strong><span style=";font-family:仿宋;font-size:20px">办理流程</span></strong></p><p style="text-indent: 40px;line-height: 39px"><strong><span style=";font-family:仿宋;font-size:20px">1、举报投诉</span></strong><span style=";font-family:仿宋;font-size:20px">。举报投诉人递交举报投诉文书,符合举报投诉条件的,填写《劳动保障监察举报(投诉)书》。</span></p><p style="text-indent:40px;line-height:39px"><strong><span style=";font-family:仿宋;font-size:20px">2、登记立案</span></strong><span style=";font-family:仿宋;font-size:20px">。符合受理条件的填写《劳动保障监察立案审批表》,报市劳动保障监察局负责人签署立案意见,负责人批准之日即立案之日。</span></p><p style="text-indent:40px;line-height:39px"><strong><span style=";font-family:仿宋;font-size:20px">3、调查取证</span></strong><span style=";font-family:仿宋;font-size:20px">。两名以上监察员同行,向被调查人出示证件,扼要说明调查理由,告之其权利和义务;填写劳动保障监察调查笔录,记明询问时间、地点、被调查人及反映的问题;结束后交被调查人签字,没有阅读能力的,读给被调查人听,可以补漏,并让被调查人签字。</span></p><p style="text-indent:39px;line-height:39px"><strong><span style=";font-family:仿宋;font-size:20px">4、申辩和听证</span></strong><span style=";font-family:仿宋;font-size:20px"><span style="font-family:仿宋">。对违反劳动和社会保障法律行为作出行政处罚或者行政处理决定前,应当告知用人单位,听取其陈诉和申辩;对作出责令停产停业、吊销许可证、对个人处</span><span style="font-family:仿宋">1000元以上,对法人或者其他组织处10000元以上罚款的,应当告知用人单位有权依法要求举行听证会,用人单位要求听证的,市人力资源和社会保障局应依法组织听证会。</span></span></p><p style="text-indent:39px;line-height:39px"><strong><span style="font-family:仿宋">①对有明显违法事实、需要整改,由劳动保障监察局负责人签署下达整改指令书,对拒不整改、拟定处罚的,由市劳动保障监察局将案卷整理后送局法规监察科审核无异后,报市人力资源和社会保障局负责人审签处罚(听证)告知书。②行政处罚(处理)决定书由市人力资源和社会保障局长签字,并加盖市人力资源和社会保障局印章后送达当事人。对重大的劳动和社会保障行政处罚案件,需集体讨论研究决定作出行政处理(处罚)决定的,集体研究后制作处理(处罚)决定书,由市人力资源和社会保障局局长签字,并加盖市人力资源和社会保障局印章后送达当事人。</span></span></p><p
