mpa-is-content="t">陕西勇智律师事务所律师管祥认为，法律上是有隐私的概念，《民法典》规定，隐私是自然人的私人生活安宁和不愿为他人知晓的私密空间、私密活动、私密信息。但要区分一般隐私视频和含有淫秽信息的隐私视频。如果是一般隐私视频，比如说他人正常的生活状态，不涉及到《刑法》所调整的范围，在未经同意的情况下向他人发送他就是一般的侵权行为。</p><p mpa-is-content="t">我国《民法典》第1032条规定，自然人享有隐私权。任何组织或者个人不得以刺探、侵扰、泄露、公开等方式侵害他人的隐私权。第1033条规定，除法律另有规定或者权利人明确同意外，任何组织或者个人不得拍摄、窥视、窃听、公开他人的私密活动；拍摄、窥视他人身体的私密部位等。</p><p style="font-size: 14px;font-family: #334695;line-height: 21px;" data-mid="" mpa-is-content="t">以牟利为目的，制作、复制、出版、贩卖、传播淫秽物品的，处三年以下有期徒刑、拘役或者管制，并处罚金;情节严重的，处三年以上十年以下有期徒刑，并处罚金;情节特别严重的，处十年以上有期徒刑或者无期徒刑，并处罚金或者没收财产。</p><p style="font-size: mpa-is-content="t">从《刑法》的规定中来看，同样是传播淫秽物品行为，区分了牟利和非牟利两种情形。以牟利为目的，传播淫秽物品的，要构成犯罪，有其法定数量标准。比如，最高人民法院、最高人民检察院关于办理相关案件的一则司法解释指出，以牟利为目的，制作、复制、出版、贩卖、传播淫秽电影、表演、动画等视频文件二十个以上的，构成制作、复制、出版、贩卖、传播淫秽物品牟利罪定罪。</p><p
